Abstract
Physician liability risks concerning confidentiality of HIV-infected patients, ethical issues surrounding the duty to inform, and questions confronting the physician in the right-to-know debate are discussed. Ethical guidelines for protecting the privacy of persons with HIV infection as well as the political and legal aspects are provided. Overall, the debate has its strongest support when there is an on-going sexual or needle-sharing relationship. In such cases, the law should empower the health care professional to disclose if there is deemed a significant risk of transmission.
